Diagnostic Lab Billing: GST Exemption Rules for Pathology Labs

Pathology billing sits at the intersection of healthcare exemption and ordinary taxable supply — and the split decides whether your invoices and returns are defensible. Here is how the GST rules actually treat diagnostic labs.

SAC 999316 in Plain Terms

Health care services by clinical establishments — including clinical diagnostic tests — are exempt under SAC 999316. A blood count for a patient on a doctor's advice is exempt supply: no GST charged, and it belongs in the nil/exempt schedule of your return.

Clinical vs Commercial: The Line That Matters

  • Clinical (exempt): tests for diagnosis, under a doctor's advice or as medically indicated panels.
  • Commercial / wellness (taxable at 18%): health packages marketed for general wellness, employment or insurance certification-type services.

The practical test courts and advisories use is purpose: diagnosis and treatment support are exempt; general wellness and commercial certification are not. Configure each test in your master as exempt or taxable at creation — and review package definitions carefully, since packages blur lines fastest.

Invoicing Mixed Panels

One invoice can carry both kinds of tests. The rule is per line: exempt tests listed as exempt, taxable tests carrying 18%, totals correctly split. Folding a wellness add-on into a "package price" with one tax treatment for the whole bundle is where labs get into notices.

Lab series discipline: dedicated LAB-INV numbering keeps lab document sequences clean in the doc sheet of GSTR-1 — the schedule most often missing in manual filing.

Home Collection Fees

Home collection charges are typically bundled with the healthcare service and follow its treatment — but where a lab charges a standalone commercial collection fee, take a documented CA opinion and stay consistent. Whatever you decide, configure it once in software and let every invoice agree with the last.

Setting Up a Lab Test Master Correctly

  1. List every test and panel you offer, with sample type and turnaround time.
  2. Mark each one as clinical (exempt) or commercial (taxable) — with your CA for any doubtful package.
  3. For packages, decide whether the whole package is clinical; if not, split the taxable part into its own line.
  4. Use a separate invoice series for lab bills so the GSTR-1 doc sheet stays clean.
  5. Review the master once a year and whenever you add a new package.

FAQ

  • Is a master health checkup exempt? If structured as a clinically indicated diagnostic package, commonly exempt; if marketed purely as wellness, treat as taxable — document your position.
  • Can I claim ITC on reagents for exempt tests? ITC attributable to exempt supplies is not available — split tracking matters for labs running both streams. Note that many diagnostic kits and reagents moved to 5% GST on 22 September 2025, which lowers the cost of the credit you cannot claim.
  • Do I need HSN or SAC on lab invoices? SAC for services — 999316 for clinical health care — shown on every invoice.
