Pharmacy GST Rates: Complete HSN Code Guide for Medicines (Chapter 30)

Ask ten chemists for the HSN code of a common tablet and you will get five wrong answers. Yet the HSN code and tax rate on your item master flow straight into every bill and into the hsn sheet of your GSTR-1. Since the GST 2.0 rate changes of September 2025, a lot of pharmacy item masters are also simply out of date. This guide maps the ground clearly.

What Changed on 22 September 2025

  • The 12% slab was removed. Most medicines and formulations that were at 12% — the bulk of a chemist's shelf — moved to 5%.
  • 36 life-saving drugs became nil-rated: 33 that were at 12% and 3 that were at 5% (the official list is in the rate notification, No. 9/2025-Central Tax (Rate)).
  • Many medical devices and diagnostic kits that were at 12% or 18% also moved to 5%.
  • Active pharmaceutical ingredients stayed at 18% — that matters to manufacturers, not usually to retail chemists.

What to do now: filter your item master for anything still at 12% and move it to the right rate. Tax is charged at the rate on the date of sale — old stock with a pre-revision MRP is billed at the new rate, and the price reduction should reach the customer.

HSN in 60 Seconds

The Harmonized System of Nomenclature is the international goods classification system; India uses up to 8-digit codes under chapter headings. For a pharmacy, HSN codes decide how your outward supplies are summarised in GSTR-1 and how your purchases match distributor invoices. Businesses with aggregate turnover up to ₹5 crore report at least 4 digits; above ₹5 crore, at least 6 digits. Since 2025 the GST portal also requires HSN codes to be picked from its own list in the GSTR-1 HSN summary.

Chapter 30, Decoded

CodeCoversTypical chemist stock
3003Medicaments not put up for retail sale (bulk, wholesaler packs)Rarely — usually distributor-level
3004Medicaments in measured doses or retail packingMost of your shelf: tablets, syrups, ointments, injections
3005Wadding, gauze, bandages, plastersDressing material
3006Pharmaceutical preparations (sutures, diagnostic reagents etc.)Surgical consumables

Outside Chapter 30, watch three frequent residents of a chemist's shelf: vitamins and nutraceuticals (often 2106 or 2936), medical devices (Chapter 9018), and ayurvedic formulations (Chapter 3004 or 3003 depending on presentation).

The GST Slabs on Medicines Now

RateWhat a pharmacy typically bills at this rate
0% (nil)The 36 life-saving drugs on the notified list
5%Most medicines and formulations (3003/3004), many medical devices and diagnostic kits
18%Some non-medicine products a chemist may stock — check each item's HSN against the current notification

The practical source of truth is still your distributor purchase invoice — it states the rate per line. But after a rate change, invoices from distributors who have not updated their own masters can be wrong too, so check unusual rates against the notification or your CA.

Updating Your Item Master

  1. Filter all items still at 12% — every one of them needs a new rate.
  2. Move formulations to 5% in bulk; check nil-rated drugs one by one against the notified list.
  3. Record HSN code and tax rate together for every new item at creation.
  4. Bill one test invoice and check the split (2.5% CGST + 2.5% SGST on a 5% item).
  5. Re-run the audit quarterly; new launches and new notifications keep arriving.
In PharmaBill: an item cannot be saved without an HSN code, and Masters → HSN Bulk Update moves many items to a new rate in one pass.

The Five Mistakes That Trigger Notices

  • Old 12% rates still in the master — the most common mistake since September 2025.
  • 3003 vs 3004 confusion — retail packs are almost always 3004.
  • Rate drift — the same product billed at two different rates in one month.
  • Missing HSN on old items — imported from a previous software without codes.
  • Device or supplement items left on a default rate — usually wrong.

A 30-Minute Item Master Audit

  1. Export your item list with HSN code and tax rate to Excel.
  2. Filter tax rate = 12%. Every row is wrong after 22 September 2025 — decide the new rate (usually 5%).
  3. Filter HSN blank or 2-digit. Fill in the full code from the latest distributor invoice.
  4. Sort by HSN and check that the same HSN does not carry two different rates without a reason (for example a nil-rated drug).
  5. Update in bulk (in PharmaBill: Masters → HSN Bulk Update) and bill one test invoice to confirm the CGST/SGST split.

Repeat this check whenever the GST Council changes rates and once a quarter for new launches.

FAQ

  • What is the GST rate on medicines in 2026? Most medicines are taxed at 5% since 22 September 2025; 36 life-saving drugs are nil-rated. Check specific products against the current rate notification.
  • How many HSN digits do I need? At least 4 digits up to ₹5 crore aggregate turnover and 6 digits above it. Capture the full code from your purchase invoice anyway.
  • Old stock still shows the pre-September MRP — what do I charge? GST applies at the rate on the date of sale. The printed MRP is only a ceiling; the reduced tax should be passed on to the customer.
  • Who decides the rate — me or the manufacturer? The rate follows the product's classification in law; your purchase invoice is your practical reference.
  • What if my accountant disagrees with an item's HSN? Fix the master, not the return — the hsn sheet is generated from the master.
